AI e-signature
AI e-signature is an e-signing flow where an AI tool such as ChatGPT, Claude or Manus prepares and sends a document for signature, and a person signs it. The AI tool does the admin work. The signer makes the signature, so its legal level under the EU eIDAS Regulation depends on how that person signs.
How it works in Formify
You connect your AI tool to Formify's e-signature MCP server and ask in plain language, for example: "Send the NDA template to anna@example.com for signing with Live ID."
- The AI tool picks the template or PDF, fills in the signer and prepares the document. You can preview it before the invitation goes out.
- The signer gets an invitation by email, SMS or WhatsApp and signs on Formify's signing page, on any phone or computer. The signer does not need ChatGPT, Claude or any other AI tool.
- The signed PDF is sealed with a qualified certificate from a provider on the EU Trusted List.
- The AI tool can check who has signed, send reminders and download the signed copy.
Is an AI e-signature valid under eIDAS?
eIDAS, the EU regulation on electronic signatures, says an electronic signature cannot be denied legal effect or use as evidence just because it is electronic (Article 25(1)). It also treats a signature as something a natural person makes, the signatory. A legal person, such as a company, uses an electronic seal to show where a document comes from and that it has not changed (Article 3(24) and (25)).
That is why the roles are split: the AI tool sends, the person signs. The level of the signature follows how the person signs:
- Simple Electronic Signature (SES): the common name for an electronic signature without identity check, such as a drawn signature. eIDAS itself just calls it an electronic signature.
- Advanced Electronic Signature (AES): a signature that meets the four requirements in Article 26 of eIDAS, among them that it is uniquely linked to the signer and capable of identifying them. In Formify, a signature with Live ID, a passport scan and a video selfie, is an AES.
Some agreements need a Qualified Electronic Signature (QES) under national law. Formify offers SES and AES, so check the rules for your agreement.
A related term, AI-assisted signing, covers AI that helps the signer understand the document while signing.
FAQ
Is a document sent by AI legally binding?
Who sends the document does not set the signature level. eIDAS looks at the signature the person makes. Whether a specific agreement is binding also depends on the agreement itself and on national law.
Can an AI tool sign on my behalf?
In Formify the AI tool prepares and sends the document. The signature is made by the signer on Formify's signing page.
Can AI verify who signed?
The AI tool can ask for Live ID when it sends the document. The signer then verifies with a passport scan and a video selfie on the signing page, and the signature is an AES.
